They exist. I haven't used one. But yes, highly illegal unless you are some sort of covert government agent. I wouldn't attempt to use one under any circumstances. Cell phones and pagers are just one of those nuisances that we have to put up with and work to educate our audiences about.

First, the OP is talking about jamming cell phone signals, not scrambling. "Scrambling" in the RF world usually refers to a process whereby the audio or data information is altered from its usual format to prevent interception by unwanted individuals.
Second, there is no constitutional or statutory right to receive RF signals for your wireless device so lawsuits are not an issue.
The only issue at hand is the one Tim stated: It's a violation of FCC regulations and US Code to operate an unauthorized transmitter and interfere with a licensed operation.
One way to address cell phone usage other than the pre-show announcement and big burley intimidating ushers is to shield the venue performance area and passively attenuate outside RF energy getting inside. Not cheap or easy, but very effective if done correctly.

Justice, yes they do exist. The unit I made has an effective range of about 25 feet. I built it in an old Garage door opener-transmitter box.
In 2001, I was in a Very Exclusive, New York City Restaurant, and they had a scrambler system installed. At the Front door, the Bar, and the Matre D' area there were signs posted advising of the scrambler, and explaining that Cell Phones would not allow calls In or Out in the immediate area.
I had built a scrambler in 1994 because of some people that happened to be on the phone all the time and not getting their work done.
I had already known about the Communications Act, although it specifically didn't address the Cell Phone issue; I knew it was only a matter of time before it did. I knew it was "morally" wrong to tamper with their service(tended to piss people off too) and that was the reason that I put it away.
But, I knew there were groups lobbying to "allow" the use of scramblers in "designated areas", the Theatre Industry being one.
I don't seem to get the FFC reports anymore, I thought possibly someone from the New York crowd may know if "zones" were ever enacted.

you're right... I was only using the term "scrambler" because that is what the Government kept calling it during their "discovery" process pertaining to the hearings on the matter.

It's a violation of FCC regulations and US Code to operate an unauthorized transmitter (no cell phone jammer manufactured has any FCC authorization) or interfere with a licensed operation. Period. No civilian exceptions. No variances.
